In Italy, the extracurricular traineeship (tirocinio extracurricolare) is regulated by the Regions, with a capped duration and a mandatory minimum allowance.
The tirocinio extracurricolare is not an employment contract; it is governed by the national Linee guida of 25 May 2017, implemented by each Region.
Duration: 2 months minimum (1 month for seasonal activities) and 12 months maximum, extensions included; 24 months for persons with disabilities (Law 68/1999).

Italian law distinguishes the contract for works or services (appalto) from the personal-work contract (contratto d'opera), both provided for in the Civil Code.
Appalto (art. 1655 c.c.): the provider carries out a work or a service for a price in money, with its own organisation and at its own risk.
The distinguishing criterion is the organisation of resources: a business structure for the appalto, essentially personal work for the contratto d'opera.
In Italy, a mainly personal, continuous collaboration organised by the client falls in principle under employee labour law; the law also protects the self-employed against certain abusive clauses.
Reclassification: employee labour law applies in principle to mainly personal, continuous collaborations whose performance is organised by the client, including through digital platforms.
Clauses allowing the client to amend the contract unilaterally or to terminate a continuous service without reasonable notice are abusive and ineffective.
In Italy, the Industrial Property Code (Legislative Decree 30/2005, Article 98) protects trade secrets; an NDA can be one of the reasonable protective measures.
A trade secret is protected (Article 98 CPI) if the information is secret, has economic value because it is secret and is subject to reasonable protective measures.
An NDA can be a reasonable protective measure: define precisely the information, the permitted uses, the term and the return of documents.
In Italy, "rilevanti" influencers are entered on a list kept by AGCOM and bound by its guidelines; advertising must be flagged from the start of the content.
"Rilevanti" influencers: at least 500,000 followers or 1 million average monthly views on one platform; obligations then extend to all their platforms.
Registration in the AGCOM elenco is mandatory; initial deadline 5 February 2026, list published and updated every 15 April and 15 October.
In Italy, Law No. 392 of 1978 sets a minimum term, tacit renewal and compensation for loss of goodwill for non-residential premises.
Minimum term of 6 years (commercial, industrial, craft, tourism), 9 years for hotels; the tenant may terminate for "gravi motivi" with at least 6 months' notice (art. 27).
Tacit renewal for successive 6-year periods (9 for hotels), unless notice is sent by registered letter 12 or 18 months before expiry (art. 28).
An acknowledgment of debt raises a presumption of the debt until proven otherwise; a usurious interest clause is void.
An acknowledgment of debt relieves the creditor of proving the cause of the debt; its existence is presumed until proven otherwise (Civil Code, art. 1988).
In a loan (mutuo), interest is due unless the parties agree otherwise (art. 1815): an interest-free loan must be expressly stipulated.
The guides cover 16 contracts: Permanent employment contract, Fixed-term employment contract, Internship agreement, Resignation letter, Service agreement, Agreement between two parties, Freelance contract, Non-disclosure agreement (NDA), Partnership agreement, Sale of goods, Influencer agreement, Residential lease, Commercial lease, Acknowledgment of debt, Car sale agreement, Power of attorney. Each one sets out the essential clauses, the rules in Italy and a template to customise online.
Each guide shows its last update date and its reference texts. This is general information and does not replace legal advice suited to your situation.
Open the contract guide, then generate the template on E-Tafakna: the questionnaire adapts the clauses, and the contract can then be signed online and archived.
